Dan advises clients on a wide range of both contentious and non-contentious employment matters. Key areas of expertise include:

  • worker and employment status cases, including defending clients from group litigation and assessing the risks in their workforce
  • sensitive disability discrimination cases involving neurodiversity and mental health conditions
  • the drafting and enforcement of restrictive covenants
  • supporting the firm's commercial department on the employment aspects of outsourcing work.

In addition to his pure employment work, Dan has particular expertise and experience in advising on wider discrimination law. This includes advising on allegations/claims made by customers against retailers and financial institutions and by service users in the transport sector. Recently, this has included advising clients on handling complaints received from the Equality and Human Rights Commission relating to disabled access to facilities and services.

Dan also has expertise in employee data protection matters and often works closely with the firm's data protection and privacy teams on advice that crosses over with employment law. 

Dan conducts regular client training and has recently spoken at employment seminars directed towards the Retail, Financial Institutions and Transport sectors. He has also presented to the In-house Employment Lawyers Network.

Dan is a member of the Employment Lawyers’ Association.

Experience

Examples of experience include:

  • successfully defending an organisation from a business critical worker status case brought by a group of its self-employed franchise partners
  • advising an insurance business on a demerger of its central functions as part of the divestment of a joint venture - that project involved Dan working as part of the client's HR project team to devise processes that, as well as being legally complaint, would result in a fair share of talent between the two businesses
  • acting for the respondent up to Court of Appeal level in L v Q Ltd an important decision on the extent of an Employment Tribunal's powers in relation to privacy and anonymity orders
  • successfully defending a holiday pay claim brought by an employee of a software company who was absent on PHI who was seeking payment of holiday pay over a 10-year period
  • advising a transport infrastructure business on its response to a complaint from the Equality and Human Rights Commission relating to access to its facilities
  • successfully defending five ex-employees of a business in an application to the High Court for a springboard injunction and an injunction to enforce restrictive covenants. This case (CEF v Brian Mundey and others) was reported and commented on in the national legal press and a number of legal updates from barristers chambers and other firms.
