Jed Nosal is a partner in the Firm's Business Litigation Practice Group and focuses his practice on state regulatory oversight, investigations, compliance, and related litigation. He is regularly relied upon by his clients to navigate complex regulatory processes, government investigations, and enforcement litigation. In navigating these government processes and actions, Jed draws from over sixteen years of representing the government at the most senior levels, including as an Assistant Attorney General and Bureau Chief in the Office of the Attorney General, General Counsel to the Department of Telecommunications and Energy and Deputy Legal Counsel to the Governor. Jed has held other state and municipal government positions, including Deputy Director of the Office of Consumer Affairs and Business Regulations and staff attorney at the Boston Police Department.
He has represented international corporations and businesses throughout New England and the U.S. to secure key regulatory approvals in the Commonwealth, including rate adjustments, long-term contracts, merger transactions, initial suitability and licensure, and frequently appears before regulators throughout state and municipal government. Jed has also defended existing licensees from regulatory enforcement actions and regularly represents companies under investigation by the Massachusetts Attorney General's Office for violations of the Commonwealth's unfair and deceptive trade practices law.
Experience
Energy, Telecommunications and Transportation
- Represented transmission developer and large hydro energy supplier in connection with long-term contract approvals in Massachusetts
- Serve as Massachusetts regulatory counsel to an international energy company in connection with Massachusetts Department of Public Utilities approval of $4.6 billion acquisition in the United States
- Negotiated multiple gas and electric supply agreements on behalf of an energy buying consortium representing nearly 500 members in Massachusetts, Connecticut, and Rhode Island
- Defended competitive energy supplier in connection with state Attorney General Investigation into alleged unfair and deceptive marketing practices
- Defended and resolved investigation of Transportation Network Company pricing investigation by the Transportation Network Division of the Department of Public Utilities
- Litigated cable basic rate cases before the Department of Telecommunication and Cable for National Communications Company
Gaming and Entertainment
- Successfully represented international gaming Company and its subsidiaries in initial suitability investigation and hearings before the Massachusetts Gaming Commission
- Successfully represented international gaming company in connection with award of gaming license in Massachusetts
- Successfully defended international gaming company in ongoing suitability investigation and fully adjudicated hearing before the Massachusetts Gaming Commission
- Successfully defended major Boston music festival producer in multiple alcohol licensing and enforcement matters
- Successfully defended international hotel in alcohol licensing enforcement actions
- Represented arcade industry in connection with Governor's COVID-19 Business Reopening restrictions allowing the industry to be recategorized and reopen their businesses
Project Development
- Represented owner of nuclear power plant and assisted in negotiating a comprehensive agreement with the Commonwealth regarding the clean-up of the site after decommissioning of the facility
- Litigated water company valuation case before Department of Public Utilities in connection with proposed municipal purchase
- Successfully negotiated memorandum of understanding with Massachusetts Historic Commission covering the preservation, partial preservation, and demolition of multiple historic structures in Springfield, MA
- Represented Boston teaching hospital in connection with the purchase and sale of microgrid and district energy system
- Defended and successfully resolved a receivership action brought by a municipality in state housing court against the owners of a major apartment complex for alleged health and safety code violations.
