The team provides transactional construction advice to the real estate, development, investment, engineering and infrastructure sectors, and works with property owners, utilities, developers and contractors to structure, negotiate and draft construction contracts, design-build agreements and economic incentive agreements. We also provide advice on managing complex construction projects.
We also deal with construction and engineering disputes, principally by way of adjudication but also arbitration (domestic and international), litigation and mediation as well as other forms of alternative dispute resolution. We regularly advise our clients on dispute avoidance, risk management and disruption strategies.
The team also defends manufacturers in class action, multi-district and “bet-the-company” mass tort litigation. Clients include manufacturers of residential and commercial building products such as asphalt roofing shingles, wood siding and trim products, windows and doors, synthetic stucco systems, decking products, engineered trusses and framing materials, built-up roofing products, elastomeric coatings, metal roof systems, and polymer-based coatings.
We have experience with a broad range of procurement issues in a wide range of sectors. Our understanding of your project needs helps us address your project needs, whether it is conducting audits on projects in respect of European Regional Development Fund (ERDF) funding or drafting and reviewing procurement documentation (including advertisements, PQQ documents, award criteria and tender instructions, evaluation methodologies and scoring guidelines) standstill letters, contract award notices, and voluntary ex-ante transparency notices.
We have substantial experience in the creation and administration of frameworks, including that for the UK central government, and in defending and bringing procurement challenges on behalf of both contracting authority and bidder clients.
