Jessica has a background in property law and now specialises in planning law, advising on both contentious and non-contentious matters. She supports the Planning & Infrastructure team advising clients (private and public sector) on regeneration projects, compulsory purchase orders (CPOs) and land compensation claims, planning applications, section 106 planning agreements, highways agreements and Transport and Works Act order (TWAO) matters. She also supports the wider Real Estate team by carrying out planning due diligence when required as part of property transactions.

Experience

Examples of experience include:

  • Acted on behalf of a London local authority on a CPO land compensation claim in connection with a town centre redevelopment where the local authority used its CPO powers to deliver a retail and leisure scheme. The case was heard in the Upper Tribunal (Lands Chamber) and is now a reported case
  • Acting on behalf of a London local authority in respect of a number of s106 agreements (including a s278/38 agreement) relating to a variety of proposed developments, ranging from a hotel to industrial warehouse space
  • Acting for a public authority in respect of an application for a TWAO for a rapid transit scheme, assisting with the provision of legal advice on all aspects of the project, including reviewing of the Environmental Statement and application documents and assisting with the legal project management of the matter
  • Acting on behalf of a public authority which has recently been allocated Levelling Up Funding, including assisting with advice on the CPO process
  • Acting on behalf of a charity in respect of complex s106 arrangements relating to its ownership of land to be promoted for sale and residential development
  • Acted on behalf of the Estates Department of a police force to ensure that adequate provision was allocated to blue light services within a new development and planning policy more widely
  • Acting for a public authority in respect of a s106 agreement required for its proposed care home development in a national park
  • Acting for a lender in respect of a number of s106 agreements designed to offset the release of nitrates, mitigate the adverse effects on biodiversity net gain and the loss of priority habitat caused by various developments in a national park
  • Acting for a statutory undertaker in negotiating protective provisions to form part of development consent orders for various nationally significant infrastructure projects in order to protect the client's apparatus from the proposed developments.
